OPERATOR: Blueground Turizm ve Servis Hizmetleri Ticaret Anonim Şirketi

The Operator is operating a fully furnished and equipped apartment that it is to be delivered to the Tenant fully functional at the date of entry and maintained all through the stay period. This is in accordance with the Turkish Code of Obligations within the scope of terms and conditions specified in this Agreement.

CONDITIONS MUTUALLY AGREED UPON AS UNDER:

1. Payment & Deposit

1.1 Monthly rent payment:

  • The Tenant will pay the monthly rental fee according to the payment plan selected at booking.

  • The Tenant can deposit the rent to Blueground’s designated corporate bank account or pay by card, in which case a processing fee may apply.

  • For rental duration up to 4 months, the full payment will be made upfront.

    1.2 Installment Fee:

In case the Tenant chooses to pay the total amount due in installments, an installment fee will be calculated based on the duration of stay and the number of payment installments.

1.3 Booking confirmation:

In the case of an online booking, the Tenant must complete the below payments within the following timeframes: i) if the online booking took place 5 or more days before move-in, the payment should be completed within 3 business days from the booking ii) if the online booking took place 1-4 days before move-in, the payment should be completed at least 1 working day before move-in iii) if the online booking took place on the same day with move-in, the payment has to be completed immediately and before move-in.

a. Deposit: The refundable security deposit will be as below:

  • 1-2 months rental duration: 1 monthly rent
  • 3-5 months rental duration: 1.5 monthly rents
  • 6+ months rental duration: 2 monthly rents

The security deposit will be refunded to the Tenant in 30 days following the departure of the tenant, subject to the premises, fixtures and fittings and furniture bteing in a satisfactory condition, allowing for reasonable wear and tear, commensurate with the condition of the same when the premises were handed over to the Tenant. In case that the paid service fees (water, gas, electricity, internet, and TV) exceed the determined amount at the end of a lease term, such difference amount shall be deducted from the deposit collected from the Tenant.

1.4 In the event that the Tenant fails to pay the full rent payment, utilities, and any other related fees within 7 calendar days of the due date Operator reserves the right to charge a late fee of 2% per month on overdue amounts for payments in foreign currency or foreign currency-indexed amounts, and 5% per month on amounts specified in Turkish Lira, or the maximum amount permitted by law, whichever is less.

1.5 For agreements in foreign currencies where payment is made in Turkish Lira, the late fee shall be calculated in the foreign currency and then converted to Turkish Lira based on the current foreign exchange rate at the time of calculation.

1.6 This fee is intended to cover the additional administrative costs incurred due to the delay in payment and will be applied in accordance with all applicable local laws and regulations. The Tenant acknowledges and agrees that timely payment of rent, utilities, and all other related fees is essential under this agreement. Failure to remit payment on time may result in the application of a late fee as described above.

1.7 If Tenant provides valid banking details and instructs the Operator to process the Security Deposit refund via bank transfer by the time of check-out, the refund will be issued to the designated bank account. If Tenant does not provide banking details and instructions by the time of check-out, the refund will be processed using the original payment method:

  • If the Security Deposit was paid via credit or debit card, the refund will be issued to the same card.
  • If the refundable amount exceeds the original card payment, the excess will be refunded via bank transfer once Tenant provides valid banking details.
  • If the Security Deposit was paid via wire transfer, the refund will be issued to the same bank account.

2. Cancellation

2.1 All cancellations must be submitted in writing.

2.2 In case the Tenant does not complete the aforementioned payments as described above, the Tenant’s booking will be canceled and the Tenant will receive a full refund except the booking fee.

2.3 For cancellations requested 15 or more days before move-in, Blueground will collect a charge equal to a half month’s rent. For cancellations requested fewer than 15 days before move-in, Blueground will collect a charge equal to one month’s rent. Any service or card processing fees are non-refundable.

2.4 Subject to the written approval of Operator, Tenant may request to be relocated to another property provided that the following conditions are met:

  • If the request for relocation is received 15 days or more prior to the Agreement Beginning Date, a penalty equal to half the Monthly Fee will be incurred and any card processing fees incurred are non-refundable.
  • If the request for relocation is received less than 15 days prior to the Agreement Beginning Date, a penalty of 1 Monthly Fee amount will be incurred and any card processing fees incurred are non-refundable.

In order for the relocation to be effective before the Agreement Beginning Date, Tenant shall pay the Monthly Rent and Service Fee, Utilities and Common Expenses and any other fee applicable for the relocated property. Any amount paid for Exit Cleaning Fees and Booking Fee and Service Fee can be transferred, however if such fees of the relocated property is higher, the Tenant shall pay the difference. If such fees are lower, the Tenant is entitled to receive the corresponding balance amount.

2.5 In case the property becomes unavailable for renting for any reason for the booking period, the Operator has a right to offer a new accommodation or cancel the booking with full refund to the Tenant.

2.6 If there is another lessee in the Leased Property and the current lessee does not evacuate the Leased Property until the Delivery Date specified in this Agreement, the Lessor, or Blueground on behalf of the Lessor, is entitled to unilaterally terminate this Agreement without paying any compensation or penalty. In such a case, Blueground shall offer a similar property in its portfolio to the Lessee. If the Lessee does not accept the premises offered by Blueground, the Lessor or Blueground shall not be liable for any compensation or penalty.

2.7 The final calculation and settlement of any refundable amounts will take place at the end of the Tenant's last booking, even if the Tenant has switched units.

3. Relocation

3.1 Following the Agreement Beginning Date, the Tenant may be relocated to different property, for an agreed duration, upon mutual agreement and subject to availability of any other available property. If such request is not a result of a bona fide deficiency in the Leased Property, a Relocation Fee equal to half month's rent will be payable by Tenant to Operator will be applicable as well as the mentioned above Cleaning Exit Fee. Tenant must provide 30 days’ notice prior to the requested relocation date, and there must be at least 45 days remaining in the Tenant's Agreement Duration for the request to be eligible.

The Tenant shall pay the Monthly Rent and Service Fee, Utilities and Common Expenses and any other fee applicable for the relocated property. Any amount paid for Exit Cleaning Fees and Booking Fee and Service Fee can be transferred, however if such fees of the relocated property is higher, the Tenant shall pay the difference.

3.2 To avoid any doubt, in the event of acceptance, Operator reserves the right to reject requests that would constitute non-compliance with the duration and conditions stipulated under Law No. 7464 regarding the Law on the Rental of Residential Properties for Tourism Purposes and Relevant Legislation.

3.3 For bookings with a Term of 12 months or longer, the Tenant is automatically enrolled in the Live at Blueground program (also called Live@Blueground), where the first relocation does not require the payment of a Relocation Fee. Reference the Live at Blueground Addendum for the full terms.

3.4 The final calculation and settlement of any refundable amounts will take place at the end of the Tenant's last booking, even if the Tenant has relocated between units.

4. Early Termination & Renewal

4.1 Provided the Minimum Stay has been met, if the Lessee intends to terminate the Agreement prior to the Agreement Termination Date, then the Lessee must notify Blueground in writing (via e-mail), at least 30 (thirty) days in advance. Furthermore, the following terms will be applicable:

  • Contracts concerning a lease period of 100 days are paid for in advance and hence, cannot be subject to cancellation or refund.

  • For contracts with a duration of over 100 days and following the 30 (thirty) days’ notice period rule, termination will be granted after the first 100 days of the contract, however the Monthly Fee for the entire contract duration (up to the requested termination date) may be adjusted to the prevailing shorter duration Monthly Fee at the time of booking. Price adjustments impact the rent and any charges that are proportionate to the rent, such as installment payment surcharges. Any service/booking, exit cleaning, or card processing charges are non-refundable.

    4.2 The Tenant holds the right to extend his lease only in the case that the Operator has been informed in writing thirty (30) days prior to the expiration date of the lease and has agreed to renew the sublease contract. The request will be granted subject to availability and mutual agreement only.

    4.3 The contract is valid up to the end of the specified period after which the date is considered null and void.

5. Cleaning & Maintenance

5.1 The Operator will be offering cleaning services, including dry cleaning and apartment cleaning, according to what was selected by the Tenant during the time of booking, at a predetermined price.

5.2 In case of any maintenance issues or malfunctioning of the infrastructure of the apartment or the equipment, the Operator will take the necessary actions to restore the premises to each previous condition in the shortest possible time frame.

5.3 In order for the property to be delivered in the same conditions, there will be an exit cleaning fee of 560 TRY for 1 bedroom, 600 TRY for 2 bedrooms, 720 TRY for 3 and 4 bedrooms apartments which will be deducted from the Deposit received by the Lessor. If the rental period is longer than 6 months, leased property is re-painted by Blueground. The cost for the paint-work will be for 1 bedroom apt - 2,250 TRY + VAT, for 2 bedroom apt - 3,000 TRY + VAT, for 3 bedroom apt - 3,600 TRY + VAT, for 4 bedroom apt - 4,100 TRY + VAT and deducted from the Deposit received by the Lessor. For the specific unit, the exit and the painting fee (if applicable) will be deducted from the Tenant’s Deposit.

6. Business Upgrade

The Business Upgrade: (the “Upgrade”) is an optional booking add-on that Lessees can purchase for their stay. The Upgrade is applied per booking version and must be repurchased to be considered valid for extensions or other future bookings. The Upgrade is an upfront charge and non-refundable. When the Upgrade is purchased, the following terms are effective for Extensions and Cancellations:

  • Extensions: Lessee has the first right to extend their stay. Extension requests must be received in writing by Blueground at least 14 days before the End Date to be considered effective. If an extension request is not received or confirmed, the extension hold will be automatically released.
  • Cancellations: Lessee can cancel their stay for a full refund if the Lessee provides notice to Blueground at least 30 days before the Commencement Date. Card processing fees are non-refundable. Cancellation requests must be received in writing by Blueground to be considered effective.

If the Upgrade is not purchased, the Upgrade terms above are considered invalid, and the standard guest agreement terms apply.

7. Promo Codes

7.1 Promo codes cannot be stacked or combined.

7.2 Once applied, promo codes cannot be swapped or changed.

7.3 Promo codes are only valid if applied at the time of booking. They cannot be added retroactively.

7.4 Blueground reserves the right to cancel promotions at any time, provided they have not been used in a completed reservation.

7.5 Each promo code has specific eligibility requirements, such as location, booking timeframe, stay length, minimum booking value, and maximum redemptions. Customers unsure of their eligibility should contact Blueground.

7.6 Promo codes do not carry over to booking extensions.

7.7 If any changes initiated by Tenant are made to a booking that violate the eligibility requirements of a promo code (e.g., early termination or cancellation), the promo code will no longer be applicable and the corresponding discount amount can be revoked and charged for payment.

8. Utilities & Taxes/Duties

8.1 The bills associated with the property including power supply, water supply, heating, building utility and maintenance fees, are to be paid by the Tenant. Monthly service fee for utilities is included in the rent specified in the Agreement.

8.2 In case of change in VAT, tax/duty and/or any other applicable taxes and duties, Rental amount and fees will be changed to incorporate relevant changes.

9. Code of Conduct

9.1 The Tenant agrees to comply with all community rules and regulations.

9.2 The premises will be occupied only by the Lessee and predefined other individuals. A maximum of 2 guests per bedroom will be staying at the premises.

9.3 The Tenant and other individuals that will reside in the property need to provide a photocopy of their Passport prior to their arrival at the property.

9.4 The Tenant cannot sublease the property under any condition.

9.5 The Tenant undertakes to use the apartment as it is stated in this contract and will not use it for any illegal purpose whatsoever. The apartment will be used strictly for residential purposes. In case of breach this undertaking, this contract shall be deemed as null and void without any judgment, warning or any other procedures initiated and shall pay rent for the remaining period of the lease or in case the rent already paid it shall not be refunded.

9.6 The Operator clearly states that smoking is not allowed in the premises. Upon determining that smoking has been carried out within the premises, a cleaning session is deemed necessary, the full cost of which will be borne by the Lessee. The smoking penalty fee will amount to 1,000 (one thousand) TRY. Failure to comply with payment will entitle the Operator to withhold the necessary amount from the Security Deposit.

9.7 The Tenant should verify if the apartment is pet-friendly prior to booking it. The Lessee hereby undertakes and agrees to remedy and pay for any damage caused to the premises and/or its contents which shall have been caused by The Pet residing at the premises. The Lessee agrees to pay for the professional cleaning of the premises at the end of The Tenancy. This will be arranged by the Operator and billed to the Lessee at 500 (five hundred) TRY.

10. Legal Jurisdiction

10.1 This agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey.
